On its last day of its term, SCOTUS granted cert to a federal case with two issues presented: (1) can a statute of limitations argument be raised for the first time on appeal and (2) if the jury instructions, unobjected to, impose additional or more stringent elements than the law itself does, must those elements -- under the law of the case analysis -- be met in determining the sufficiency of the evidence?
