The Department of Corrections sent out [this letter ]yesterday to everyone in the criminal justice system, advising us that they will often need plea paperwork and indictments to help them determine whether an inmate should get 20% or 30% good time. However, most of the time those documents won't be needed if the following information gets onto the judgment:
- The sentencing guidelines grid block
- The applicable subclassification factors for Burglary (e.g., occupied dwelling, dangerous weapon, etc)
- The quantity possessed for drug crimes
Since they're requesting charging documents to determine these questions, it is especially important to get the information on the judgment if there's a favorable difference between the conviction and the charge.
