So what are the outstanding merger issues?

I mentioned in my last post that there weren't many big outstanding merger issues left. But there are still some. What are they?

As I noted, there's MCS and DCS, MCS and PCS and DCS (subst quantity) and PCS.

There's also Unlawful Use of a Weapon and Menacing, which has won at least once at the trial level.

Assault III (based on dangerous weapon and extreme indifference) and Reckless Endangering. Think of a DUII car accident where the victim is injured but not seriously. Let me know if you want a brief on this one.

Multiple Identity Theft counts when the state has failed to show the "victim" was either a real person or alive at the time the identity was stolen.

Multiple counts of Encouraging Child Sex Abuse, when the state has failed to show the child victims were still alive when the pictures were downloaded/viewed.

Those are the big ones. Someday soon, I'll write about some of the smaller but entertaining merger issues you might want to preserve.
