SCOTUS Denies Cert Again on Non-Unanimous Juries

This morning, the US Supreme Court issued orders from last Friday's conference.

The Court has refused again to hear a case testing the constitutionality of non-unanimous jury verdicts in criminal cases. The new case was Miller v. Louisiana (12-162). The Court also denied review of that issue in two other cases, 12-5163 and 12-5199, involving the McElveen brothers, in a New Orleans murder case.

Recognizing that change isn't prompted because people have changed their minds, since even smart people usually don't, Max Planck once said, "Science progresses funeral by funeral." There may need to be a few retirements before the issue is finally addressed by something more than a plurality opinion.
