Parole Board Power (on ag murder cases from the '80s)

The Oregon Supreme Court today finds that the Parole Board has the power, pursuant to ORS 163.105 (1985), to override a 30 year mandatory minimum sentence for aggravated murder when the board finds, after 20 years of the sentence having been served, that the prisoner is likely to be rehabilitated within a reasonable amount of time. In fact, the Parole Board has the power to override two consecutive 30 year sentences after 20 years. State v. Janowski/Fleming; State v. Severy/Wilson
