Driver stopped when passenger’s license taken

A driver is stopped when an officer takes the driver’s name and the passenger’s ID to conduct a warrants check. "State v. Dierks", 257 Or. App.__(2013).

PER CURIAM OPINIONS:

  • Restitution is inappropriate in the absence of a causal relationship between the defendant’s criminal conduct and the victim's economic loss. "State v. McDonald', 257 Or. App. __
  • The word ‘use' in ORS 166.220(1)(a) - unlawful use of a weapon - describes both the actual use of physical force and the threat of immediate use of physical force. "State v. Boggs", 257 Or. App.__ (2013)
