Judicial Fitness

The record showed, by clear and convincing evidence, that respondent, a circuit court judge, had engaged in willful misconduct. He was suspended without pay for three years. The court made a lengthy analysis of a complex set of facts and concluded that respondent had engaged in misconduct in several particulars. The court also made findings about the procedural requirements for judicial discipline cases, and repeatedly cited lawyer discipline cases, which are based on a similar statutory framework.
